Terms of Use and Purchase Policies

1. Acceptance of these terms

By accessing the website, purchasing a product or service, creating an account, or submitting documents, you agree to these Terms of Use and the Privacy Policy. Paid checkout requires affirmative agreement before payment. If you do not agree, do not purchase, submit documents, or use the tools or services.

2. Professional use and scope

Products and services are workflow and decision-support resources for mortgage and real-estate professionals. They are educational and informational. They are not legal, tax, accounting, credit-repair, lending, brokerage, appraisal, compliance, title, or underwriting advice.

Mortgage File IQ does not act as a lender, loan broker, creditor, attorney, accountant, title insurer, appraiser, or final underwriter through this website. Users remain responsible for verifying calculations, documents, conclusions, eligibility requirements, and possible scenarios against current source documents and applicable agency, investor, lender, employer, licensing, compliance, and legal requirements.

3. No guarantee and no final income or DTI determination

An income workup is an independent calculation based on the documents supplied and generally used mortgage-industry methods. It is intended to help users understand, double-check, or discuss a calculation. It does not establish the qualifying income or DTI used by a lender and does not supersede an authorized underwriter’s determination.

Underwriters may reach different results based on agency or investor requirements, lender overlays, program rules, updated documents, information not supplied, and professional judgment. A workup or review may help identify a possible calculation conflict, but it cannot guarantee that a suspended or denied loan will be approved or that any loan status will change.

4. Products and services

Digital tools

Digital tools are self-service HTML instruments and downloadable professional resources. A purchase grants a limited, non-exclusive, non-transferable license for the purchaser’s professional use. It does not include analysis of a specific loan file unless a human-assisted service is separately purchased.

Mortgage File IQ U/W GPT Assistant

The U/W GPT Assistant is a protected, account-based AI decision-support feature for redacted professional questions about AUS findings, income, conditions, and file structure. It may be purchased by itself and is separate from the public chatbot, self-service instruments, and human-assisted document reviews. It does not connect to, submit to, modify, reproduce, or replace Desktop Underwriter, Loan Product Advisor, a lender system, an investor system, an authorized underwriter, or an official underwriting workflow.

AI limitations, hallucinations, and user verification

Artificial-intelligence output is probabilistic and may hallucinate or fabricate information, misread or misunderstand a prompt, omit relevant facts, rely on incomplete or outdated information, or state an incorrect conclusion confidently. A clear, precise, complete, and properly redacted prompt may improve the usefulness of a response, but no prompt wording guarantees accuracy or completeness. Incorrect, incomplete, ambiguous, or poorly framed information may produce a materially incorrect response.

By purchasing or using the U/W GPT Assistant, the user acknowledges these limitations and agrees not to treat any response as definitive or as the sole basis for a loan, income, underwriting, compliance, or business decision. The user must independently verify every material statement, calculation, interpretation, and suggested next step against the original DU/LPA/AUS findings, current agency guides and release notes, investor and lender requirements and overlays, source documents, and direction from the applicable authorized underwriter or compliance professional.

The U/W GPT Assistant is for informational professional-workflow support only. It does not provide legal, tax, accounting, financial, credit, compliance, lending, or underwriting advice; determine qualifying income or DTI; issue an approval; clear a condition; or guarantee any loan result or status change. The user remains responsible for how the output is interpreted, verified, communicated, and used.

Do not enter Social Security numbers, dates of birth, complete account numbers, passwords, or other unnecessary sensitive identifiers. The assistant does not accept file uploads; separately purchased document reviews use the secure customer intake.

Income workups

Human-assisted income workups review the purchased unit shown at checkout—for example, one borrower, one entity return, one rental property, or one bank-statement set—and return a written PDF summary. Multiple borrowers, businesses, entities, accounts, or properties are priced separately unless a written package states otherwise.

Complete-file review

The complete-file service is a broader human-assisted review of the documents submitted and may include calculations, documentation gaps, possible conditions, title observations, and discussion scenarios. It is not a final underwriting decision.

Partner directory and advertising add-on

The lender directory, partner platform, and sponsored-placement packages are a separate product module and are not included in any core tool license or subscription. Directory suggestions are informational only and are not referrals, endorsements, recommendations, or promises of qualification or availability.

Advertising fees are flat monthly charges paid for sponsored placement weight inside an otherwise eligible state-and-loan-type match. Fees are never based on a lead, application, referral, rate, loan term, closing, compensation, or borrower outcome. Paid placement is always labeled “Sponsored” or “Advertisement.” Trusted Partner status is separate, is earned through tool use and owner review, cannot be purchased, and is never created by an advertising payment.

Directory and chatbot suggestions are never ordered by rate, price, loan terms, or deal quality. Borrowers and professionals must independently verify licensing, NMLS information, programs, guidelines, pricing, terms, availability, and suitability before contacting or working with a listed party.

5. Pricing and additional complexity

The website displays the price, purchased unit, and billing cadence before checkout. Posted tool and review prices are one-time unless clearly stated otherwise. If a file contains work outside the purchased unit or unusual complexity, Mortgage File IQ may pause the review and provide a written quote. No additional charge is made without acceptance.

The 10-workup W-2 package includes ten wage-earner workups for one purchasing business and expires 90 days after purchase. It does not include self-employed, entity-return, bank-statement, or rental-property work unless separately purchased. Unused workups expire at the end of the 90-day period and are non-refundable except where required by law.

7. Missing-document notice

If documents needed to complete an income or file review are missing, Mortgage File IQ may send a notice identifying the missing items. The customer has 48 hours from that notice to provide the requested documents or submit a cancellation request. Cancellation is not automatic and requests are reviewed manually. If the customer does not respond within the notice period, the order may be closed and becomes non-refundable except where required by law.

8. Digital-product refund policy

Downloaded or accessed digital tools and resources are non-refundable because electronic access cannot be returned. Duplicate charges, technical delivery failures, or purchases that have not been downloaded or accessed should be reported promptly for review. Nothing in this policy limits a non-waivable right under applicable law.

9. Income and file-review cancellations

A request to cancel a human-assisted service should be received within 48 hours of purchase. A customer who receives a missing-document notice may also submit a cancellation request during that notice’s 48-hour response period. Requests are reviewed manually and are not automatically approved. No refund is available after the completed work has been delivered, after material review work has been completed, or after an unanswered missing-document notice expires, except where required by law or when Mortgage File IQ cannot deliver the purchased service.

10. Customer documents and authority

You represent that you are authorized to submit every document and item of information provided. Submit only what is necessary. Redact Social Security numbers, full account numbers, passwords, and other unnecessary sensitive information whenever possible. Do not submit loan documents through the public chatbot, ordinary email, WhatsApp, Instagram, or other social media; use the secure customer intake.

11. License restrictions

Products may not be resold, redistributed, sublicensed, published, copied for unlicensed users, made publicly accessible, or used to create a competing product. Multi-user access requires written team terms.

12. Availability and updates

Mortgage File IQ may correct, update, replace, or discontinue features when reasonably necessary. “Lifetime” refers to the lifetime of the covered product offering, not the purchaser’s lifetime, and does not promise that every feature or third-party service will remain available indefinitely.

13. Limitation of responsibility

To the fullest extent permitted by law, Mortgage File IQ is not responsible for a customer’s lending, underwriting, compliance, employment, business, or legal decisions; third-party decisions; or indirect, incidental, special, or consequential losses arising from use of the website, tools, calculations, reports, or services. Where liability cannot be excluded, total liability will not exceed the amount paid for the product or service giving rise to the claim.

14. U/W GPT Assistant plans and cancellation

The U/W GPT Assistant can be purchased as a standalone product. The monthly plan renews monthly until canceled. A cancellation stops future recurring charges after the payment provider confirms it; access continues through the then-current paid-through date and the current period is not refunded. The 12-month pass is a one-time payment that expires after 12 months and does not automatically renew. Operator System assistant access expires 90 days after purchase. Usage allowances do not roll over, have no cash value, and may not be shared or automated.

The assistant may be temporarily unavailable for maintenance, provider interruption, abuse prevention, safety, or compliance reasons. Users may not scrape, resell, share credentials, automate bulk submissions, use the assistant to create a competing service, or use it to discriminate, misrepresent information, alter documents, or evade lending requirements.

15. Advertising subscription cancellation

Partner advertising is billed as a separate monthly add-on. Cancellation stops future recurring advertising charges after the payment provider confirms cancellation. Cancellation does not convert prior flat advertising fees into referral compensation and does not affect separately purchased tool access. Suspended, past-due, canceled, expired, or unmatched listings receive no paid placement boost.
